How do I generate a draft bail order?

Run the Draft Bail Order tool from the client’s own page and it prepares the court’s order granting bail, with the conditions your client is bailed on, as a Word document. It works for any court (Magistrates, District or Supreme) and for both first grants and variations.

  1. Open the client’s page, click the menu, then Draft Bail Order.
  2. Choose the type: a fresh bail application (starts with an empty checklist) or a bail variation (pre-fills the client’s existing conditions to edit).
  3. Set the court, the prosecuting authority (QPS, The King, DPP or CDPP), who it’s before, and the file number. The order and filed dates print with blank space to hand-write if you leave them empty.
  4. Check the charges: pre-filled from the client’s charges. Edit each line, add one by hand, or upload a charge sheet.
  5. Add the bail conditions you need (see below).
  6. Review and Generate to download the Word document.

The order is signed by hand by the Magistrate or Deputy Registrar, so no signature is added. Always check every detail before presenting it to the court.

Adding conditions

Click Add condition to pick from the standard clauses, write your own, or pull shared wording from the clause library: see How do I add conditions to a draft bail order?.

Variations

On a variation, the existing conditions appear kept word-for-word. Edit or delete any, and where one matches a standard clause a Use standard wording button swaps in the template version. If nothing is saved yet, upload the current Form 7 undertaking to load the conditions (and optionally save them to the Bail tab).

Note: the show-cause reasons paragraph is always included; edit it on the document if needed.
